A soldier does have the right to disobey an unlawful order! Bush invasion and occupation of Iraq was an unlawful and illegal act of aggression. Why should any "Critically Thinking Patriotic Service Member" want to associated with possible War Crimes? Where's the honor?

According to International Law, the Bush invasion and occupation of Iraq has turned into War Crimes. Bush and his hencemen and brown shirts has rendered America to a lawless state, where the rule of law and our constitution has been suspended!

You do know our military service members have taken the oath to defend America against ALL ENEMIES, both Foreign and Domestic. The Bush Admin. is skirting the line with their behavior over the last 8 years of becoming "DOMESTIC ENEMIES OF AMERICA!", keep that in mind.

Bush's war in Iraq was not undertaken in self-defense. Iraq had not attacked the US, or any other country, for 12 years. And Saddam Hussein's military capability had been effectively neutered by the Gulf War, 12 years of punishing sanctions, and nearly daily bombing by the US and UK over the "no-fly-zones."

The dropping of 2,000-pound bombs in residential areas of Baghdad during "Shock and Awe" were crimes against humanity. The indiscriminate US attack on Fallujah, which was collective punishment in retaliation for the killing of four Blackwater mercenaries, was a crime against humanity.

The destruction of hospitals in Fallujah by the US military, its refusal to let doctors treat patients, and shooting into ambulances were crimes against humanity. Declaring Fallujah a "weapons-free" zone, with orders to shoot anything that moved, was a crime against humanity.

Point is Rob, look how many Nazi German soldiers who were on trial for crimes against hummanity and who were hanged at Nuremberg b/c their only saving argument or excuse was "THEY WERE FOLLOWING ORDERS"! How about the lowering ranking service members at Abu Griab.....who were only following orders, and where are they now!!!! There in FUCKING PRISON! b/c they followed ILLEGAL ORDERS AND IGNORED THE GENEVA CONVENTION!

Lastly Rob, as you and I are two honorabaly discharged proud serving military retired veterans, we are well versed and understand the Uniform Code of Military Justice, in articles 90-92, sets forth the duty of military personnel to obey lawful commands.

The Nuremberg Principles, which are part of US law, provide that all military personnel have the obligation not to obey illegal orders. The Army Field Manual 27-10, sec. 609 and UCMJ, art. 92, incorporate this principle. Article 92 says: "A general order or regulation is lawful unless it is contrary to the Constitution, the law of the United States.

The Bush administration is committing crimes against the peace, war crimes and crimes against humanity in Iraq.

I agree with much of what each of you say. Most of us carry forward the ideals of America as it once was. Now, we're mislead at every step by a government no longer representing us, and in fact, a government so corrupt I don't even recognize it anymore. All the while a manipulating media is jerking us around while omitting reality except as they deem it useful for their purpose. I feel for this young man because the adults in this country haven't stood together and said ENOUGH. It's tough applying the old rules in this altered universe. The old rules of duty and responsibility need to apply for our own security because you can't have your military deserting but this kid's caught up in something not of his making. We've let him down.

Rasta, yes I am well aware of UCMJ. How is it that a soldier refuses to deploy right? Congress supported the war until it became a political issue.

A soldier has every right not to deploy to an unlawful and illegal deployment where the rule of law and the Geneva convention is being ignored. Do you encourage or support you children to reside or participate in an illegal endeavor b/c of excuse of IDEOLOGY? of course not. Our military is controlled and led by the Civilian Segment of our Country, and rightfully so, I mean afterall we do not want to see America ran by military juntas' or dictators, however, we as private citizens and as military members both active, reserve, guard, vets, and retired vets have every right to hold our Civilian Govt accountable for their actions and acts of lawlessness

I find it amusing that the SAME people who trash the UN any other time, pull it out of they ass whenever it fits their needs

What was the UN Mandate violation claim, 4th or 5th time Bush changed the spin on his reasons for going to war?

Based of violation of UN mandates and resolutions, when do we invade Israel ?

Of course not. That's not what social programs are FOR. And the military isn't FOR getting money for college, or traveling to exotic places, or being lazy. It's FOR defending one's country, as the discretion of the President and Congress of the United States. Ads don't always portray it that way.

The Military is the biggest welfare giveaway program, and corporate subsidy and price support in the federal budget .

It is also the most fraud ridden, bloated and wasteful of all Government entities

It is used as a haven for those who need to hide from the real world due to they being inept, and a means to house, and feed their equally inept milingering dependents

The Military has not "defended this country" in 60 years
