Gateway Pundit: Marines Will Sue John Murtha for Defamation of Character
Lawyers for Marine Staff Sgt. Frank D. Wuterich are filing a suit in Federal Court today.

A Marine Corps staff sergeant who led the squad accused of killing two dozen civilians in Haditha, Iraq, will file a lawsuit today in federal court in Washington claiming that Rep. John P. Murtha (D-Pa.) defamed him when the congressman made public comments about the incident earlier this year.
Attorneys for Frank D. Wuterich, 26, argue in court papers that Murtha tarnished the Marine's reputation by telling news organizations in May that the Marine unit cracked after a roadside bomb killed one of its members and that the troops "killed innocent civilians in cold blood." Murtha also said repeatedly that the incident was covered up.
In the court filing, obtained by The Washington Post, the lawyers say that Murtha made the comments after being briefed by Defense Department officials who "deliberately provided him with inaccurate and false information." Neal A. Puckett and Mark S. Zaid, suing for libel and invasion of privacy, also wrote that Murtha made the comments outside of his official scope as a congressman.
Telephone calls yesterday to Murtha's office in Washington were referred to his district office in Pennsylvania, and calls there were not returned. A Marine Corps spokesman declined to comment yesterday on the Haditha investigation or the lawsuit.

Right Smitty....but, the problem is that Murtha is not the judge or the jurry here, Smitty...and he can voice his opinions like everyone else. I agree that what he did was wrong, but that doesn't necessarily make him liable or guilty of slander. If it was reasonable for him to believe what he was saying at the time he was saying it, then there are no grounds for a law suit....at least against him.

He is a senater. HE KNOWS BETTER! He slandered these troops for political reasons! The troops couldent tell their side of the story and neither could their parents! They were ordered by the courts to keep silent all while Murtha saw an political oppertunity to make America look bad in Iraq! Murtha told the world that thoes troops murdered those innocent Iraqis in cold blood all before the trial even started! Ofcourse now thay are all exonerated and rightfully looking for some payback! Murtha deserves everything that is coming to him. We do have the freedom of speech but we still dont falsley yell "fire" in an crowded theater!

Well, if they can prove what you are saying, then they may have something. My guess is that it will be hard to prove. Mutha will probably just say that he was saying what he thought was true at the time. Unless they can find eyewitnesses to collaborate your take on this Smitty, the law suits will probably go no where.
