Firstly, the combatants are not "persons under US jurisdiction" and are therefore not entitled to equal protections under the US constitution.

Rights exist by virtue of legal positivism; a right does not exist unless the violation of its conditions will be reprised.

The citizen is the foremost benefactor from the establishment of rights within the collective institution, while all else may be subject to natural law.

If the greater individual, which is the collective institution, should be dissolved into lesser individuals, as a result of disparate views, then many may succumb to natural law.
(The second amendment is GOD).

To improve ones' chances of survival within such conditions of nature, through civil contract with mutual agreement, to act as a greater individual, one surrenders their natural freedoms (morally relative actions) for citizenship, in exchange for reprised legal rights, with the formation of a collective institution under constituiton.

Citizens are afforded legal rights within the institution while all others are potentially subject to unreprised, morally relative actions, which are naturally inherent to nature.

It is a requirement of humanities nature, I don't know why you insist on seeing mankind as something foreign to nature, and it's properties separate.
