One thing that bothers me about this is that Sharpton has stated it was time to talk to broadcasters about what would be permitted to say and what would not be permitted to say. That sounds remarkably like censorship to me.

No broadcast facility owner or advertiser can be constitutionally compelled to pay for speech that they do not support.

BTW: I don’t listen or watch Imus and I know practically nothing about him. I heard about this current controversy only 2nd and 3rd hand.

I make the distinction between political speech and commercial speech (things like strip clubs and false advertising claims). I do not have any qualms about regulating commercial speech.

But, since you cannot be an airwaves broadcaster in this country without getting the government’s permission (the FCC), we do not have freedom of speech in any broadcast media. Whether or not this is right or wrong depends on whom it is that owns the broadcast airwaves. I would be more inclined than not to say the airwaves are not public property and thus cannot be legitimately regulated by the government. But that does not negate the fact that Imus was being paid to speak and thus could not exercise total freedom to say whatever he wanted to say. His advertisers and the people that gave him access to a broadcast facility and airtime are certainly within their right to regulate what he says.
