Who is arguing for an "absolute right" determination?

There are no absolute rights in an ordered society but there are illegitimate exercises of power in a system such as ours of clearly defined and limited powers.

Much of gun control is on the wrong side of that line and until now the authority to enact and enforce those laws has been endorsed by the "collective right" theory as created in the 1940's by the lower federal courts. When that theory is finally buried by the Heller decision, the cases using that reasoning will, for all intents and purposes, be reversed and the support structure for those laws will vaporize.

I'm not saying that there is no legitimate state interest in many of the present gun control initiatives, just that many are built upon an illegitimate base rooted in fantasy, not within the constitutional limits of power.
