California's top court overturns gay marriage ban - Yahoo! News
SAN FRANCISCO - The California Supreme Court has overturned a voter-approved ban on gay marriage, paving the way for the state to become the second in the United States where gay and lesbian residents can marry.
The justices released the 4-3 decision Thursday, saying that domestic partnerships are not a good enough substitute for marriage in an opinion written by Chief Justice Ron George.
Outside the courthouse, gay marriage supporters cried and cheered as news spread of the decision.
In striking down the ban, the court said, "In contrast to earlier times, our state now recognizes that an individual's capacity to establish a loving and long-term committed relationship with another person and responsibly to care for and raise children does not depend upon the individual's sexual orientation, and, more generally, that an individual's sexual orientation — like a person's race or gender — does not constitute a legitimate basis upon which to deny or withhold legal rights."

Isn't banning homosexual marriage violating the constitution in the first place?

Gay marriage is a state's right issue, that's why the people of California voted to ban Gay marriage.
The people of CA. made their decision by a vote and a panel of Judges determined the people of CA. do not have that freedom.

Nope. State has the right to discriminate in the granting of marriage licenses for a variety of reasons.

It was a Republicant vote.
Now, they're irrelevant.
We're gonna ship all the Bushbots (12) in California to Kansas too, unless they enlist voluntarily.

What do you expect from the San Franciso 9th District Liberals ? Not to worry... A Referendums in place that'll negate the Libs,,,and allow the People themselves to vote on this.

That won't happen... Perverts and genetic misfits haven't the ability to see the stupidity of being the exact opposite of the Natural process...
