Where in the constitution does it say that strights can marry? It doesn't, so I guess that out as well, huh?
However the constitution does allow for judicial review of stupid laws, to see if they are in fact constitutional. When they are not, Judges toss them out. You don't like that? Change the constitution.

Why does America have a Constitution? It only makes things complicated and breeds a lawyer class. They will be the first to be shot when we take over your country.

Evidently too many have been listening to rightwing radio. The decision was based on California's state constitution and decided by a 'conservative' court. 6 of the 7 justices were appointed by Republican Governors--you know, those wacky 'liberal' governors we had in office, like...Pete Wilson and George Dukmejian.

No, all states have marrage laws. most of which say straights can marry, or what that state will recognize as legal. Thats why the gays need to pass new laws to get married.

Here's the thing, if its not in the constitution, it's a state rights issue. The state and its' citizens get to decide how to handle that isssue. Marrage, for anyone isn't a constitutional right.
I know your a smart man TEAK, I think you can see the difference between stopping two people from seeking happiness (constitutional right) and stopping them from getting married. (privilage granted by statute)

And that is supposed to prove what? Mr. Reagan appointed people to the US Supreme Court that was "anything" but upholding to his personal ideologies. Your obvious "political bigotry" shows that you believe that "Judges" are supposed to toe the "political line" instead of performing their "constitutional mandated duty" of merely "arbitrating" any impasse of the law by drawing their powers of "judicial review" from the "guaranteed" rights contained in the US Constitution and or the following amendments thereof. Any Judge's personal ideologies should have no bearing whatsoever upon the decision making process of judicial review. And if no breech of any rights contained in the Constitution is found evident, ALL REMAINING WORDING ARE THE SOLE PROPERTIES OF THE "STATES/WE THE PEOPLE"....according to the 10th article of our BILL OF RIGHTS, which continues to be ignored time and time again as "NEW LAW" is opined from the bench at any "whim" of agreement to these APPOINTED JUDGES, solely by the "self professed" power of "IMAGINED" authority by these little legal dictators. California has its own constitution? Holy shit! And in this document they give the right to marry to gays? This constitution must cover about everything! Which hand can you people wipe your ass with? They must have a special building to put it in. It must be huge. Well I guess CA is really fucked up. Have to live it though, Constitution right to gay marriage in Califorinicate. At least they can't say "California, the land of fruits and nuts." any more.
