To Judge Morrales;
On Wednesday, December 5th 2007, at 8:30 I appeared in court for a traffic violation with you as the Judge. I have heard much good about you in being fair and prudent in your decision making. Due to this please do not take this as a criticism but rather as my point of view of what occurred to me during my plea of guilty with no contest to the charge of exhibition of speed. The clerk informed you correctly of that it was not for speeding which you thought I was there for but rather for “exibition”when. I had attempted to explain to you that it was not intentional exhibition as it occurred due to my unfamiliarity with the vehicle just having registered it no more then one half hour prior which I had just purchased a week prior at the police action of drug running vehicles. I had my mechanic after the incident retard the vehicles acceleration and I was not pulled over in a reasonable period of time during which I stayed below the speed limit unaware that I was being followed by the Bisbee Police for the incident as it happed at the gas station across the street from Bank of America in Warren and with a Bisbee Police officer across the street. I had driven from there, picked up an acquaintance along the way that was walking on the road side by the train underpass, made it around the traffic circle and was pulled over by four Bisbee Police cars right in front of the Bisbee police station. I am not attempting to change your verdict upon me for this incident but rather bring to you attention of my attempt to politely and with the public in view not contest you or the Bisbee Police Department in any way but rather explain it in a way that would not be derogatory to the Bisbee Police Department. I will admit I was not pleased with the 6 (six) point and $442.00 (four hundred and forty two dollar) fine but I accepted it. However again the clerk, apparently with out your knowledge, with out what I believe is not legal and not on the court recording, when I was talking to her, modified your court order and increased the fine on her own by $200.00 (two hundred dollars) to $642.00 (six hundred and forty two dollars) telling me again you had made an error again, the third time she corrected you during my session.
On the bright spot I did, before having to leave on a business emergency, did take a seat and hear the next case in which the parents explained why their daughter had not appeared in court as she was in jail at the time of the court date and it was explained to the court at that time and you dismissed the charges and fine, which I found to most admirable of you.
I would really like to hear your view on this issue about the clerk over riding your sentencing of my case which you were neither notified of or approve of. Also maybe what I could have done to correct it then and there rather then requesting you to take the time to call me and explain what went wrong in the court room that day. I have the belief that you may take the time to call me to discuss this issue and hopefully will not take this as a criticism of our court system but rather my hope that it will make it better for all of us in the future, hopefully in all future meetings it will be in a restaurant or coffee shop rather then in a court room.
Could you please take a minute of your time, even if it before or after business hours to give me a call on my cell phone at (520) 266-2261 to clear my mind of my perception of what can be improved upon (in my opinion) and prevent it from again occurring or advise me of what legal/civil action you feel I should take to prevent this from occurring to others.
Sincerely
Thomas E. Heering
