But what you seem to be ignoring is that a hate crime has two elements. A guy who kills the man he is robbing has committed two crimes correct? This combination allows for the crime to be tried as a capital crime... Maybe that is the way we should go... How about if instead of calling it a hate crime they called it a capital crime. Would that change things? Remember what we commonly know as a hate crime is not always race based. It has applications towards religion, sexual orientation and other groups. But still what we justify as a hate crime now still has the second element that a simple crime lacks. Terrorism.

But motivation is a fact that has to be proven in court unless you plan to argue completely circumstantial evidence.

To try a different vein. If you are attacked for being in the wrong neighborhood then gang stuff is probably why. If you are attacked because the guy was crazy then that differs.
