What an incredible lack of judgment. I will bet that this kid has been a discipline problem from day one and the teacher is just FED UP with the misbehavior and has been wracking her brains trying to find a way to get through to him.

However, this is just the WRONG way. I don't care how many times she needs to remove him from the class, you always assure the child that it is *his* actions that are excluding him from the class, and that when he behaves appropriately, he will be welcomed back warmly. For that power to be put in the hands of his peers is wholly inappropriate.
