I am sorry but rules are rules. This may sound like a petty deal but somewhere along the line this was an issue with people having a pack of dogs and letting them run free. While it seems that we should allow some leeway the problem then becomes, what about Micheal Vicks dogs, should someone be allowed to take care of them while he is in the slammer? Where do you draw the line.

A few years ago a woman had several pet goats in a residential neighborhood. The city law was that you could not have "farm" animals in a residential neighborhood. Some neighbors wanted her to be able to keep them until one neighbor said, if she is allowed to keep her goats then I am going to get pigs or maybe even a cow or chickens.

No, if the law says 4 or less, maybe the father should get rid of one of his dogs rather than try to make the city look like the bad guy here.
