It doesn't need to because the 9th Amendment which says

Now, that is a pretty vague statement....which others??? IMO, it was deliberately vague on purpose and would be subject to interpretation by later generations. And that is exactly what they did...."they" being the Courts as they are charged with role of interpretation of the Constitution.
